Plea of Alibi-Murder-Accused defendant that he was at some other place on official work from 10 a.m. to 2 p.m.-Deceased had categorically stated in his dying declaration at just about 10 a.m. accused set him ablaze-Therefore, prior to 10.30 a.m. the whereabouts of the accused were not surely stated-He was assigned the official work at 9.40 a.m.-Therefore, between 9.40 a.m. and 10.30 a.m. the location of the said accused was not shown to have been in a different place other than the place of occurrence-Plea rejected-Conviction upheld- Indian Penal Code, 1860, S.302.;;
